Terms of Service

Welcome to Theraspace. These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and Theraspace ("Theraspace," "we," "us," or "our") governing your access to and use of the Theraspace website, application, and related services (collectively, the "Service"). By creating an account, logging in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What Theraspace Is

Theraspace is a training and simulation platform. It provides a simulated, AI-generated conversational partner ("mock client" or "AI client") that therapists, trainees, students, and other clinical learners can use to practice therapeutic technique in a low-stakes environment.

Theraspace is not:

  • A healthcare provider, telehealth service, or substitute for clinical supervision.
  • A source of medical, psychological, psychiatric, or diagnostic advice for you or any third party.
  • A crisis service. Theraspace is not designed, tested, or intended to respond to real mental health emergencies.
  • A tool for treating, diagnosing, or documenting care for real patients or clients.

The AI client is a simulation. Its responses are generated by a third-party large language model and are fictional. Nothing the AI client says constitutes clinical guidance, real patient data, or a real therapeutic record.

If you or someone else is in crisis: stop using the Service and contact your local emergency number, or in the United States call or text 988 (Suicide & Crisis Lifeline). Theraspace has no ability to see, respond to, or escalate real-world emergencies, whether they involve you, a colleague, or anyone you may reference in a simulated session.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for:

  • Providing accurate information when registering.
  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.

We use Auth0 to manage authentication. We do not store your password. Notify us promptly at the contact address below if you suspect unauthorized use of your account.

3. Acceptable Use

Theraspace is intended solely for practicing clinical technique against a simulated client. You agree not to:

  • Input real patient, client, or third-party personal health information ("PHI") into the Service. Do not paste, type, or otherwise submit identifiable details about real people you treat or have treated, including in session notes, scenario descriptions, or chat messages. Theraspace is not built or certified as a HIPAA-compliant system for handling real PHI, and you are solely responsible for anything you input.
  • Use the Service to make real clinical decisions about a real person, or as documentation of real patient care.
  • Attempt to use the AI client's output as a diagnosis, treatment plan, or professional opinion applicable to a real person.
  • Use the Service in a way that is unlawful, harassing, abusive, or that attempts to extract, reverse-engineer, or misuse the underlying AI models.
  • Upload malicious code, attempt unauthorized access to our systems, or interfere with the Service's operation or other users' access to it.
  • Use the Service to generate content that exploits, endangers, or sexualizes minors, or that is otherwise illegal.
  • Misrepresent your identity, credentials, or professional licensure status in a way intended to deceive Theraspace, other users, or any institution relying on your use of the Service.

We may suspend or terminate your account for violating this section, with or without notice, at our discretion.

4. Content You Submit

You retain ownership of the session prompts, scenario configurations, and other original text you submit ("Your Content"). By submitting Your Content, you grant Theraspace a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display it as necessary to operate and improve the Service, including sending it to third-party AI model providers (e.g., Amazon Web Services / Bedrock) to generate responses.

Do not submit real PHI, trade secrets, or confidential information belonging to a third party. You are solely responsible for Your Content and for confirming you have the right to submit it.

5. AI-Generated Output

Responses from the AI client are generated by machine learning models and may be inaccurate, clinically implausible, biased, or inconsistent with real therapeutic best practice. We do not review, verify, or endorse AI-generated output before it is shown to you. You should apply your own professional judgment, training, and supervision when evaluating anything the Service produces, and you should never treat AI-generated content as authoritative clinical guidance.

6. Intellectual Property

The Service, including its software, design, trademarks, and underlying technology (excluding Your Content and third-party AI model output), is owned by Theraspace or its licensors and protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, we grant you no other rights, and you may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Subscription, Fees, and Changes to the Service

Some features of the Service may require a paid subscription. Fees, billing terms, and any free-tier limits will be presented to you at the point of purchase and are incorporated into these Terms by reference. We may modify, suspend, or discontinue any part of the Service — including specific features, models, or scenario libraries — at any time, with or without notice.

8. Disclaimers

THE SERVICE, INCLUDING ALL AI-GENERATED OUTPUT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

Theraspace does not warrant that using the Service will improve your clinical skills, satisfy any licensure, certification, continuing-education, or supervision requirement, or produce any particular outcome. Any decision to rely on your practice with the Service in real clinical settings is made entirely at your own professional risk and discretion.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERASPACE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR CLINICAL OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY AI-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERASPACE'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID TO THERASPACE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Theraspace and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of: (a) your use or misuse of the Service; (b) Your Content, including any real PHI or third-party information you were not authorized to submit; (c) your reliance on AI-generated output in a real clinical or professional setting; or (d) your violation of these Terms or applicable law.

11. Termination

You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms, without liability to you. Sections 4–10 and 13–14 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice (such as an in-app banner or email). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, unless applicable law in your jurisdiction requires otherwise. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

14. Miscellaneous

  • Entire Agreement: These Terms, together with any Privacy Policy and order forms incorporated by reference, constitute the entire agreement between you and Theraspace regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • No Waiver: Our failure to enforce any provision is not a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent; we may assign them freely in connection with a merger, acquisition, or sale of assets.
